Mortgage registration company seeks dismissal of deceptive trade lawsuit

A nationwide electronic mortgage registry has requested that a Delaware judge dismiss a deceptive trade practices lawsuit that has been filed against the company.

Mortgage Electronic Registration Systems, Inc, has argued that there are no grounds for deception in their trade practices because they only operate for their members, which are financial institutions, and not the homeowners.

Representatives for the company have stated that there is no way that there could have been false advertising because there is no ‘commercial activity’  transacted between the registry and homeowners.
